Wells Fargo Home Mortgage Wage and Hour Litigation
Chan, et al. v. Wells Fargo Home Mortgage, Inc.
United States District Court for the Western District of Washington at Seattle
Case No. 2:11-cv-00871
In April 2011, this wage and hour case was filed against Wells Fargo Home Mortgage, Inc. (a division of Wells Fargo Bank, N.A.) on behalf of current and former Washington-based Home Mortgage Consultants. The lawsuit alleged that Wells Fargo Home Mortgage failed to pay its Home Mortgage Consultant employees overtime, meal breaks, rest breaks, and reimbursable business expenses required by Washington law.
In 2011, the lawsuit was transferred to a federal district court in Texas. The case was returned to the United States District Court, Western District of Washington in 2014.
After review of exhaustive discovery and contentious negotiations, the parties agreed on settlement terms in May 2015.
On October 1, 2015, the Court entered the Order Approving Class Action Settlement and Certifying Settlement Class. On November 20, 2015, the Settlement Administrator mailed the settlement distribution checks to the class members.
