Case Overview

The Petitioners Anne Broome and William Gurtner filed this class action lawsuit on October 10, 2014.  Petitioners are seeking increased benefits under the University of California Retirement Plan (“UCRP”) for themselves and a class that has been certified by the Court. Petitioners contend that class members are entitled to these increased benefits based on a 1999 resolution of the UC Regents adopting a “Restoration Plan” that included restoration of benefits that had been limited by application of a particular section of the Internal Revenue Code.

The Regents have denied all of Petitioners’ claims. The Court has not yet resolved the merits of those claims.

Case Status

The Court has certified a class defined as:

“Former faculty and staff of the Regents of the University of California (“UC”) who (1) participated in and were eligible to receive benefits from the University of California Retirement Plan (“UCRP”) upon retirement; (2) retired after January 1, 2000 and prior to March 29, 2012; and (3) whose retirement benefits were reduced as a result of Internal Revenue Code  (“IRC”)§ 401(a)(17)”

A Court-authorized Notice will be mailed to all of the members of the Certified Class on July 1, 2019. We urge you to review the Notice carefully and completely as there is an important deadline by which you must act if you choose to exclude yourself from this lawsuit. If you want to remain in the lawsuit, you do not need to do anything.

The Court has set the trial to begin on October 7, 2019.
