Keller Rohrback L.L.P. Appointed Interim Co-Lead Counsel In Theranos, Inc. Litigation

In re Arizona Theranos, Inc., Litigation, In the United States District Court for the District of Arizona, Case No.: 2:16-cv-2138-PHX-HRH

In the summer of 2016, Keller Rohrback L.L.P. filed Class Action Complaints California and Arizona federal courts against Theranos, Inc. and Walgreens Boot Alliance. Theranos claimed to have developed a “tiny blood test,” and it formed a joint venture with Walgreens to market its product and offer it in select Walgreens retail stores. The vaunted technology did not work. Thousands of Theranos test results were invalidated and thousands of others called into question. Theranos was investigated by federal and state regulators, it was sued by a major investor and it was even sued by its former business partner, Walgreens. On October 12, 2016, United States District Judge H. Russel Holland ordered that the Theranos cases filed in Arizona be consolidated into a single action for pretrial purposes. The Court appointed Keller Rohrback and Leiff Cabraser Heimann & Bernstein as Interim Co-Lead Counsel for the putative class action.

Keller Rohrback partner Gretchen Cappio described the task ahead: “We are honored the Judge Holland chose our firm and the Lieff Cabraser firm to serve as Interim Co-Lead Counsel for plaintiffs in this litigation. This is a significant consumer protection case because every patient should be able to trust the accuracy and reliability of his or her medical test results. When a big company takes advantage of that trust, it robs the customer of money and also robs the patient of informed choice about medical care. We intend to press forward to hold Theranos and Walgreens accountable for this grievous breach of trust.”

Keller Rohrback and its Interim Co-Lead Counsel continue to investigate the claims asserted by Theranos customers. If you have information about Theranos’ misconduct or seek additional information about the lawsuit, please contact us.
