Processed Egg Products Pricing

Keller Rohrback L.L.P. is involved in litigating this antitrust action proceeding in the United States District court for the Eastern District of Pennsylvania concerning anti-competitive practices.  The claims allege that the defendants engaged in a conspiracy to fix, raise, maintain and stabilize prices at which shell eggs and egg products were sold in the United States in violation of Section 1 of the Sherman Antitrust Act, 15 U.S.C. § 1.  The defendant’s unlawful conduct caused the plaintiffs and other similarly situated direct purchasers of shell eggs and egg products at artificially inflated prices that were more than what would have been paid in a competitive market.

The Court recently denied in large part various motions to dismiss filed by various of the defendants.

The Court also issued an order limiting the time frame under which claims can be made. 

Plaintiffs have reached preliminary settlements with two defendants for a total of $25m.  A motion is before the court seeking final approval of those settlements.
