Court Upholds Keller Rohrback’s Claims Against Nationstar Mortgage and Solutionstar for Alleged Excessive Inspection Fees

Keller Rohrback L.L.P. is currently acting as co-lead counsel in Contreras v. Nationstar Mortgage L.L.C., a class action lawsuit filed against Nationstar Mortgage L.L.C. (NYSE: NSM) and its subsidiary Solutionstar L.L.C. in the U.S. District Court for the Eastern District of California.  The Contreras complaint is on behalf of homeowners from multiple states and alleges that Nationstar, together with its subsidiary Solutionstar, use an automated system to illegally, unfairly, and fraudulently charge borrowers for multiple and repetitive “property inspections,” and other fees.  This system and the fees being charged are not required nor permitted by lenders or by federal regulations and guidelines.

On August 10, 2017, the Court issued an order upholding nearly all of the claims, noting that “Plaintiff has sufficiently alleged that Defendants engaged in deceptive conduct in the servicing of Plaintiff’s loan.” According to Keller Rohrback partner Derek Loeser: “Nationstar’s and Solutionstar’s abusive servicing practices have subjected our clients to inappropriate and excessive fees. We are pleased the case can now move forward and we look forward to vigorously pursuing all relief on behalf of our clients and the classes they seek to represent.”
